General Terms and Conditions
1. Scope
These Terms and Conditions apply to all orders placed through www.lierre-sauvage.com by consumers and business customers. A consumer is any natural person who enters into a transaction for purposes outside their trade, business or profession.
2. Contract formation
By placing an order on our website, you make a binding offer to purchase the selected product. We will confirm receipt of your order by email. A binding purchase contract is formed when we send a separate order confirmation or dispatch the goods.
3. Prices
All prices are stated in euros and include applicable VAT where required by law, if shipped inside of the European Union.
Shipping costs are shown separately during checkout and in your order confirmation. For deliveries outside the European Union, additional customs duties, taxes and fees may apply. These are borne by the customer.
4. Payment
We accept the following payment methods: credit card, PayPal, bank transfer via Shopify. Payment is due immediately upon order placement unless otherwise agreed.
5. Delivery
We deliver to the countries listed in our shipping information. Estimated delivery times are stated during checkout. Delivery times are non-binding estimates. Risk of accidental loss and deterioration of goods passes to the customer upon handover to the shipping carrier.
6. Retention of title
Goods remain our property until full payment has been received.
7. Custom commissions
Custom commissioned works are produced exclusively to the individual specifications agreed with the customer. As such, they are exempt from the right of withdrawal as set out in Section 4 of our Withdrawal Policy. Production begins only after receipt of the agreed deposit. Dispatch will take place once the full amount has been received by Lierre Sauvage. All commission terms are set out in a separate commission agreement.
8. Warranty
Statutory warranty rights apply. If you receive a defective or damaged item, please contact us within 48 hours of receipt with photographic evidence at info@lierre-sauvage.com
9. Liability
We are fully liable for damages resulting from injury to life, body or health, from intentional or grossly negligent breaches of duty, and in accordance with the German Product Liability Act. For other damages caused by simple negligence, our liability is limited to foreseeable, contract-typical damages.
10. Governing law and jurisdiction
These Terms and Conditions and any disputes arising from them are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms and Conditions is Nuremberg, Germany, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
11. Dispute resolution
The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board and do not generally participate in such proceedings.
